Five Power-of-Attorney types we draft weekly in Bangkok
Our notarial practice handles roughly 180 POAs per month, falling into five recurring patterns. (1) Property POA — granting a Thai-resident relative, lawyer or property agent authority to sign a sale-and-purchase agreement, lodge transfer documents at the Land Office and receive proceeds, used by overseas-resident sellers and inherited-estate beneficiaries. (2) Vehicle POA — using Department of Land Transport Form ก. to transfer car ownership, renew tax discs, or surrender plates when the owner is overseas. (3) Banking POA — for opening, operating or closing Thai bank accounts on behalf of an overseas signatory; each Thai bank has its own template (Bangkok Bank Form 1003, Kasikorn Form POA-2024, SCB Form L43) and demands a notarized + apostilled + Thai-translated version. (4) Corporate POA — director delegating signing authority to a country manager, or company empowering an outside lawyer to file BOI / Work Permit / Visa / DBD documents. (5) Court POA — civil-litigation or criminal-defendant proxy, governed by Civil and Commercial Procedure Code sections on attorney representation, requiring a Thai Bar Association-licensed lawyer as attorney-in-fact.
How to draft a Thai POA that won't be rejected
- Identify the grantor with: full legal name (passport spelling AND any prior Thai-transliteration variant), passport number, nationality, country of issue, country of current residence, date of birth.
- Identify the attorney-in-fact with: full Thai name in Thai script AND English transliteration, Thai national ID number (13 digits), Tabien Baan address, telephone number.
- State the SCOPE of authority in numbered paragraphs — each paragraph one specific power; vague phrases like 'all such acts as may be necessary' will be struck out by Land Office clerks.
- Quantify limits — maximum purchase or sale price, minimum acceptable price, account-number ceiling for banking POAs; without limits the counterparty must treat the POA as unlimited and most reject.
- Include a duration clause — start date, end date, or trigger event (e.g. 'until the transfer is registered'); open-ended POAs are now refused by Bangkok Bank and Kasikorn under their 2025 KYC update.
- Append exhibits — passport copy of grantor (every page with a stamp), passport-style photo of attorney-in-fact, and any document the POA refers to (e.g. the chanote land title).
The apostille chain for POAs signed outside Thailand
If a client signs a POA in the US, UK, Germany, France, Italy, Spain, the Netherlands, Australia, Canada or another Hague Apostille country, the document must (1) be notarized by a local notary public in that country, (2) receive an apostille from the country's Competent Authority (US Secretary of State per state, UK FCDO, German Bezirksregierung, French Service Central d'État Civil, Australian DFAT, Canadian Global Affairs), (3) be translated into Thai by a translator whose specimen signature is on file with the Thai MFA, (4) the translation must be certified at the Thai Ministry of Foreign Affairs Department of Consular Affairs. For non-Hague countries (China, UAE, Saudi Arabia, Kuwait, Vietnam pre-2025, most African countries) the apostille step is replaced by Thai-embassy legalization in that country, which adds 5–14 working days. Our Bangkok office can coordinate the translation and MFA step for clients who have already obtained the apostille; we cannot perform the apostille itself because that is a sovereign act of the foreign authority.
Mistakes that void a Thai POA
- Two-sided printing on Land Office forms — Form อ.16 must be printed single-sided on A4 because the back of the page is reserved for the Land Office clerk's annotations.
- Signing in blue ink with a fountain pen — Thai government offices require black ballpoint or fineliner; blue and fountain-pen ink smear under their dampening pads during inspection.
- Photocopying the grantor's passport in colour but not certifying every page — Land Office and DBD require the lawyer to initial each photocopied passport page.
- Omitting the attorney-in-fact's Thai national-ID copy — the Land Office must verify the recipient's identity against the national database before accepting transfer documents.
- Using a Specific POA after its end date — Specific POAs lapse automatically; the Land Office will reject without notice if the transfer date is after the lapse date.
Bilingual POA drafting, MFA timeline and fees
We draft Thai/English bilingual POAs side-by-side on A4 with paragraph numbers aligned, so the grantor reads the English column and the Thai counterparty relies on the Thai column. Drafting time: 45 minutes for simple Specific POA, up to 3 hours for multi-transaction corporate POAs. Notarization (when the grantor is in Thailand): ฿2,000–฿4,500 depending on length. MFA Legalization for outbound POAs: standard 2 working days at ฿200 per page, express same-day at ฿800; the destination embassy in Bangkok then adds its consular legalization. For inbound POAs (signed abroad), the Thai translation runs ฿800–฿1,800 per page and MFA certification is ฿200/page standard or ฿800/page express. Total turnaround for the end-to-end inbound chain: 4–7 working days from receipt of apostilled original.
